We only request personal data when it is necessary to provide a service; we do so by lawful and transparent means, and we always inform you of the purpose of the collection and how the data will be used.

This Privacy Policy sets out the terms governing the processing of personal data carried out via the Website, in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 — “GDPR”) and Law No. 58/2019 of 8 August.

Depending on the purpose, we may process the following categories of data: identification and contact details (name, company, job title, address, email, telephone number), data contained in quote requests and messages sent via the Website (including drawings, technical specifications or files attached by the user), and connection and browsing data (please also see our Cookies Policy).

We do not process special categories of personal data via this website.

The personal data requested on the forms on the website is, as a rule, necessary in order to respond to the request or to provide the services. Failure to provide this data may make it impossible to respond to the request or to enter into the contract.

4. Purposes and legal basis for processing

We process users’ personal data for the following purposes and on the following legal grounds:

Enquiries and requests for information: To manage and respond to requests for information, technical queries and communications submitted by telephone, email or via forms on the website. Legal basis: legitimate interest in responding to requests for information from potential customers and partners; and performance of the contract, where the request relates to an existing relationship.

Quotation requests: To review and respond to requests for quotations for waterjet cutting, laser cutting, bending, welding and machining services submitted via the website. Legal basis: pre-contractual measures at the data subject’s request.

Business relationship management: To manage the provision of the contracted services, communication with the client and compliance with the associated legal obligations, in particular tax and accounting obligations. Legal basis: performance of the service contract and compliance with legal obligations.

Website Analysis and Improvement: To carry out statistical analyses of usage in order to evaluate and improve the functioning of the website and its services. Legal basis: consent, in the case of analytics cookies (see the Cookies Policy), and/or legitimate interest in improving the services, as applicable.

5. Retention periods

We retain personal data only for as long as is necessary for the purposes for which it was collected. Enquiries and requests for quotations are retained for as long as is necessary to process them and, should they not result in a business relationship, for a further reasonable period for the purposes of responding to new enquiries and defending any rights. Data relating to contracted services, invoicing and legal obligations is retained for the applicable statutory periods, in particular the period required by tax and accounting legislation, and for the duration of warranty periods and limitation periods for rights.

Once the applicable time limits have expired, the data is deleted or anonymised.

6. Disclosure of data to third parties

For the purposes set out above, personal data may be disclosed to: providers of technology, hosting and information systems maintenance services; providers of administrative, accounting and invoicing services; and public, judicial, police or regulatory authorities, where such disclosure is required by law.

Service providers who process data on behalf of TSwaterjet act as data processors; they are bound by contract and are obliged to ensure the security and confidentiality of the data.

If any service provider is located outside the European Economic Area, data will be transferred in accordance with the appropriate safeguards provided for in the GDPR, namely adequacy decisions or standard contractual clauses approved by the European Commission.

TSwaterjet takes appropriate technical and organisational measures to protect personal data against destruction, loss, alteration, unauthorised disclosure or access, taking into account the nature of the data and the risks involved in its processing.

8. Rights of data subjects

In accordance with the GDPR and Law No. 58/2019 of 8 August, you may, at any time and free of charge, exercise your rights of access, rectification, erasure, restriction of processing, data portability, objection and withdrawal of consent, as well as the right not to be subject to decisions based solely on automated processing, by sending a written request to TSwaterjet via email [email protected] or to the address specified in clause 2.

The data subject also has the right to lodge a complaint with the supervisory authority, the National Data Protection Commission (CNPD) — www.cnpd.pt.
